That's not true - you can get Hyperion ROMs too.

I have a physical Hyperion 3.1 ROM in my Amiga 2000 right now.

It needs to die. The Amiga and all its copyrights need to die so that it might live again.

It never did truly die. Just beaten to an inch of its life, with the limp body being dragged around and defiled since 1994. It's a Wonderful Life was an absolute failure as a new movie when released. It was only a blunder by the studio in not renewing the copyright that allowed anyone to do with it what they will... and their will was to constantly air it over network and independent television stations, making it the classic it is today. This system of constant renewal for people who deserve no rights... It needs to end.

FYI - I had this issue with the set of A3k ROMs I picked up a while back. I had other unrelated hardware issues so put off dealing with it. In the meantime, Cloanto added this as a known issue that has been corrected, and after I contacted them a replacement set is being shipped to me.

if you actually read the court evidence in the Cloanto v Hyperion case you can see that Hyperion are acting like children and essentially stealing the market from Cloanto - and have been doing this for many years. I can understand why Cloanto are hesitant to invest in improvements when Hyperion are constantly threatening to take them to court (for which they need to set aside money for lawyers, hampering their ability to invest).

Jens unfortunately sided with the guys who he thought had a legal right to AmigaOS 3.1 and less and this has bitten him badly. He made wild acusations against Cloanto for P96 after not doing his due diligence. He really should sue the authors who sold him P96 when they had accepted money for a license in the past but not disclosed the details. Money paid to the P96 authors by Cloanto wil be enough to back up their claims. So what if it was $1000 back then - it was a deal that described the value of the product at that time - the authors were clearly OK with it and did not see there to be a future. It was Cloanto's gamble that paid off - and frankly gave them a good user experience in good faith.

Realistically looking at the court docs, there is so much in favour of Cloanto that it's hard to see Hyperion getting out of this one. They have finally fought back, and hard.

Cloanto all the way. I just hope Jens can reach out to Cloanto and work with them (I love his hardware), instead of walking away because of what from the outside looks like a tantrum for ending up on the wrong side of his deals with the P96 authors and Hyperion, who saw opportunities and took them.

@invent, that might be what happens - their silence thus far is making everyone run around with hair on fire and jump to conclusions (including me). As dalek points out, there is always another side to things. And right now all we really know is that Jens is skipping an Amiga event for lack of funds because "legal issues with Cloanto is binding lots of resources."

We don't technically know who instigated the legal issues even though the implication is Cloanto did. But it could entirely be the other way around. I just don't care anymore!

At this point, all this does is reinforce my own personal disgust with Hyperion and Cloanto in general. If they both disappeared tomorrow I would not shed a tear. Just being honest, folks.

If Jens closed up shop I would be upset.

And life would go on.

I thought I understood what was going on here. The more I learned the foggier this all became. I give up. Back to Secret of the Silver Blades for me.

Can you link me to the court evidence? I would like to read this.. Or, more precise, I would like my lawyer girlfriend to do so and explain it to me :roll:

I got this last night. I'll post it here without comment as I've started to mentally/emotionally unplug from this.

doing to Hyperion. Hyperion made a new OS, and Cloanto is attempting to
keep that from the community.

Amiga is about makers, and Hyperion is a maker. Cloanto is selling GPL'd
software that others have written for free.
